Construction disputes in Dubai are decided in arbitration, mostly at the Dubai International Arbitration Centre (DIAC), or in the onshore courts. Abu Dhabi disputes increasingly go to arbitrateAD. In arbitration, each party usually appoints its own delay expert. In the courts, the judge normally appoints an expert from the official register, and the parties present their case through that expert. We work in both settings.
An expert’s duty is to the tribunal, not the party paying the fee. We say at the start if the records will not support the position you want, so the case can be adjusted early. Reports follow the IBA Rules on the Taking of Evidence where the tribunal applies them, and the SCL Delay and Disruption Protocol for method.
