Construction disputes in the UK go to adjudication under the Housing Grants, Construction and Regeneration Act 1996, to the Technology and Construction Court, or to arbitration. Each sets a different pace: an adjudication decision is due within 28 days of referral unless extended, while TCC proceedings run for months. Expert evidence in court must comply with CPR Part 35 and its Practice Direction.
We follow the SCL Delay and Disruption Protocol and explain any departure from it. Our duty under CPR Part 35 is to the court, so we tell you early if the records will not support the case. We check for conflicts before reviewing any documents.
